Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the website and services operated by Edge Wise Dwelling ("us", "we", or "our").

Your access to and use of our services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use our services.

By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access our services.

1. Services

Edge Wise Dwelling provides home renovation and remodeling services ("Services") as described on our website. Our Services include, but are not limited to, kitchen renovation, bathroom remodeling, living room and interior upgrades, roofing and exterior renovation, flooring and carpentry solutions, and painting and wall finishes.

We reserve the right to refuse service to anyone for any reason at any time.

2. Quotes and Estimates

All quotes and estimates provided by Edge Wise Dwelling are subject to the following conditions:

  • Quotes are valid for 30 days from the date of issuance unless otherwise specified.
  • Quotes are based on the information provided by the client and visual inspection of the property. Any unforeseen issues discovered during the renovation process may result in additional costs.
  • Quotes include only the specific work items detailed in the written estimate. Any additional work requested will be subject to a separate quote and agreement.
  • Estimates are approximations and not fixed prices unless explicitly stated as a "firm quote" or "fixed price contract."

3. Contracts and Agreements

Upon acceptance of a quote, clients will be required to sign a formal contract that outlines:

  • Detailed scope of work
  • Project timeline and completion date
  • Payment schedule
  • Material specifications
  • Change order procedures
  • Warranty information

No work will commence until a signed contract is received along with the required deposit payment.

4. Payment Terms

Our standard payment schedule is as follows:

  • 30% deposit upon signing the contract
  • 30% payment at project mid-point
  • 30% payment upon substantial completion
  • 10% final payment upon full completion and client satisfaction

For projects exceeding $50,000, a customized payment schedule may be established in the contract.

Payments can be made by check, bank transfer, or credit card. Credit card payments may incur a processing fee of up to 3%.

Late payments will incur interest at a rate of 1.5% per month on the outstanding balance.

5. Change Orders

Any modifications to the original scope of work must be documented in a written change order that includes:

  • Detailed description of the additional or modified work
  • Cost implications
  • Impact on project timeline

Change orders must be signed by both the client and a representative of Edge Wise Dwelling before the additional work commences.

Verbal instructions or agreements will not be considered valid change orders.

6. Project Timeline and Delays

While we strive to complete all projects within the agreed-upon timeline, certain factors may cause delays, including:

  • Weather conditions that prevent work from being performed safely
  • Discovery of unforeseen structural issues
  • Delays in material delivery from suppliers
  • Changes to the scope of work requested by the client
  • Permit delays or inspection issues
  • Force majeure events (natural disasters, pandemics, etc.)

Edge Wise Dwelling will communicate any delays promptly and work diligently to minimize their impact on the project completion date.

7. Warranties

Edge Wise Dwelling provides the following warranties on our work:

  • 1-year warranty on workmanship
  • Manufacturer warranties on installed products and materials (varies by product)

Our workmanship warranty covers defects in installation and labor. It does not cover:

  • Normal wear and tear
  • Damage caused by client misuse or neglect
  • Issues arising from client-supplied materials
  • Modifications made by other contractors after project completion

To make a warranty claim, clients must notify us in writing within the warranty period, describing the issue in detail.

8. Client Responsibilities

Clients are responsible for:

  • Providing clear access to the work area
  • Removing valuable or fragile items from the renovation area
  • Making timely decisions on selections and approvals
  • Ensuring that someone authorized to make decisions is available during critical phases
  • Securing necessary permits if specified in the contract as a client responsibility
  • Making payments according to the agreed schedule

9. Termination

Either party may terminate the contract under the following conditions:

Termination by Client:

Clients may terminate the contract by providing written notice. The following terms will apply:

  • If termination occurs before work commences, the deposit will be refunded less a 10% administrative fee.
  • If termination occurs after work has begun, the client will be responsible for paying for all work completed, materials ordered, and a 15% fee on the remaining contract value.

Termination by Edge Wise Dwelling:

We reserve the right to terminate a contract if:

  • The client fails to make payments as scheduled
  • The client repeatedly interferes with or delays the work
  • Unsafe conditions are discovered that cannot be reasonably remedied
  • The client breaches any material term of the contract

In such cases, the client will be responsible for all costs incurred up to the termination date.

10. Intellectual Property

All designs, drawings, specifications, and documents prepared by Edge Wise Dwelling remain our intellectual property. Clients may use these materials only for the specific project for which they were created.

We reserve the right to photograph completed projects and use these images for marketing purposes, unless the client explicitly requests otherwise in writing.

11. Dispute Resolution

In the event of a dispute, the parties agree to attempt resolution through good-faith negotiation. If negotiation fails, the dispute will be submitted to mediation before any litigation is initiated.

If mediation is unsuccessful, any legal action must be filed in the appropriate courts of California, which shall have exclusive jurisdiction over any disputes arising from these Terms or our Services.

12. Limitation of Liability

Edge Wise Dwelling's liability for any claim arising out of or related to our Services shall not exceed the total amount paid by the client for the specific project giving rise to the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or relating to these Terms or our Services, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory.

13. Insurance

Edge Wise Dwelling maintains comprehensive general liability insurance, workers' compensation insurance, and professional liability insurance. Certificates of insurance can be provided upon request.

Clients are advised to maintain their own homeowner's insurance policy throughout the renovation process.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using our Services.
